Right of withdrawal

If you are a consumer (i.e. if you are not a business and you do not purchase products from us for purposes that are wholly or mainly connected with a business or trade that you carry on), you have the right to cancel the contract concluded with us when you purchase products on the website [www.outof.com/de-de][1]. You can revoke the contract at any time and for any reason within the revocation period.

TERM OF CANCELLATION The cancellation period begins when we send you the email confirming shipment and ends 14 calendar days after the day on which the product(s) are delivered to you. If you have ordered multiple products as part of a single order and we deliver those products to you in separate shipments, the withdrawal period will end on the 14th day after the day on which you receive the last of the products from that order.

Since determining the withdrawal period can be somewhat difficult, we would like to explain how to calculate the period that applies to you using the following example: You place an order on April 1. We send you a shipping confirmation email on April 3. You receive the delivery of your products on April 7.

The period to cancel the contract starts on April 3 and ends on April 21 (that is, it expires after 14 calendar days, starting from the day after delivery). Weekends, legal and other holidays are to be counted when calculating the 14-day period.

EXERCISE OF THE RIGHT OF REVOCATION To revoke an online order, please follow the instructions below:

Let us know that you intend to cancel. To do so, please use the cancellation form that we inform you about here or clearly declare to us in any other way (e.g. by e-mail/letter) that you want to cancel your contract. In any case, you must send your completed cancellation form or your message to our customer service before the end of the 14-day [cancellation period][2].

Return the products in question to us at the following address: Dahlemer Weg 190A, 14167 Berlin (Germany). The return must be made no later than 14 days after your notice of cancellation to us. Weekends, public and other holidays are to be counted accordingly. For furniture items, please contact our customer service team to arrange a collection. Please note that when exercising your statutory right of withdrawal, products must be returned by mail and cannot be returned to a store.

We are not obliged to refund you before receiving the products you have returned or before proving that you have returned them to us. We therefore recommend that you use a secure or trackable shipping method, i.e., registered or certified mail, and also retain your shipping receipt.

FURTHER PROCEEDINGS Provided that you have cancelled the Contract as described above and that we have received the Products back from you within 14 days of cancellation of the Contract (or you have provided us with evidence that you have returned the Products to us within the same period), we will refund to you all payments received from you for the Products, including delivery charges, in the amount of the cheapest form of standard delivery offered by us. We may make a deduction from the refund amount for any loss in value of the delivered Products if such loss is the result of improper handling by you.

The refund will be paid (using the same means of payment that you used for the original transaction) within 14 days of receipt of the returned Products or proof of shipment of the Products. In the case of products that we have agreed to pick up (for example, in the case of furniture), the refund will be paid within 14 days of your notice of cancellation to us. Please note that this right of withdrawal does not apply in the following cases: (1) contracts for the supply of goods that are not prefabricated and for the manufacture of which an individual selection or determination by the consumer is decisive or which are clearly tailored to the personal needs of the consumer, (2) contracts for the supply of goods that can spoil quickly or whose expiration date would be exceeded quickly, (3) contracts for the supply of sealed goods, which are not suitable for return for reasons of health protection or hygiene, if their seal has been removed after delivery, (4) contracts for the delivery of goods if these have been inseparably mixed with other goods after delivery due to their nature, (5) contracts for the delivery of sound or video recordings or computer software in a sealed package if the seal has been removed after delivery.

Please note that the statutory right of withdrawal is supplementary and in addition to your other statutory consumer rights and the 30-day cancellation and return options granted by us.
